Appellations of Origin

The registration of the appellation give its owner exclusive rights to prevent others from using the the registered appellation or a confusingly similar appellation in relation to the same or similar  goods or services.

What is an Appellations of Origin ?

Appellations of Origin

An appellation of origin is a special kind of geographical indication, more precise than it, used on products that have a specific quality that is exclusively or essentially due to the geographical environment. 

How to protect your Appelation in Algeria

By Filing

 -    a national appellations of origin application to the Algerian National Institute of industrial property (INAPI ).

-    an international application presented to the International Bureau by the competent authority of the country of origin.

Procedure for Registration

-   Conducting an appellation of origin Search:

            Before applying for a an appellations of origin, we recommend that a validity for the appellation and a state of the art

           Searches must be conducted in order to determine whether your appellation is available for use or not.   

- Drafting and filing Application

  a)- Application for appellation of origin must be filled into four copies and  must  include the following:

(i)         The name and address of the applicant(s).

(ii)        The appellation origin for which the registration is sought and the area of production of products.

(iii)       The products to which the appellation applies

 

              c) - payment of the prescribed fees

             The application must be accompanied by the payment of the prescribed fees.

                 d) - Signed power of attorney

     

 Duration and Renewal of Registration

            Each registration shall remain in force for 10 years from the date of filing.

            Registration may be renewed for a periods of 10 years at the end of each successive 10 year period.

 

International Application

 

Algeria joined the Lisbon Agreement for the protection of appellations of origin (Act of Stockholm October, 31, 1973) in July, 5th, 1972.

An international application shall be presented to the International Bureau by the competent authority of the country of origin on the official form provided to that end and shall be signed by that authority.

The application has to be filed in accordance with the Lisbon formal requirements accompanied by the prescribed international fees.
